What is Canadian PR Visa under the spousal sponsorship?

The Canada Spouse Visa comes under the ‘Spousal Sponsorship Program’ which is a category of Family Class Immigration. This program helps Canadian citizens and permanent citizens to sponsor their spouse/ common-law partner/ conjugal partner for Canada PR. Both the sponsor and the person who is receiving sponsorship must have approval from IRCC to receive a visa. After getting the sponsorship your spouse can come, work and settle in Canada.

 

Who can become a Sponsor?

To apply under this program, you must prove that your relationship comes under one of the following:

  1. Spouse is someone who marries you and is of the opposite sex.
  2. Common-law Partner is someone who is in a conjugal relationship with you for at least 1 year. Also, you need to show that you both live together regularly for the above said period. And you must show proof of common residence.
  3. Conjugal Partner is a common-law partner who is not able to live with you regularly. And it can also be your spouse who is not able to marry you through legal means. This can be due to marital status, sexual orientation or immigration issues.

Note: Canada tops in supporting equal rights and accepts the LGBTQIA+ community. It has a zero-tolerance policy towards any bias and gives them equal rights. Even in its Sponsorship program, you can sponsor your same-sex partner. As it accepts same-sex marriage and same-sex partners who can apply under the above three options.

 

What are the types of Spousal Sponsorship in which you can apply?

You can apply for Canadian PR Visa under:

  1. Outland Sponsorship is when your spouse is living outside Canada. However, you can be living in Canada and still apply for this visa. Canada may allow you to travel in and out of the country. The visa process will happen in the visa office of your home country. If not, then at the place where you live for at least 1 year through legal means.
  2. Inland Sponsorship is applicable when the spouse lives in Canada. Your common-law partner/ spouse is living with you on a temporary status as a student, visitor or worker. And, when you sponsor your partner, they can also apply for an Open Work Permit. Because this will help them to work under a Canadian employer while their application is in processing.

 

How can you Sponsor your Spouse, Common-law Partner or Conjugal Partner?

You can now have your family by your side in Canada. And you can do that by becoming a Sponsor, for which you must meet the following terms:

  1. The person you want to sponsor should be a part of your family. If they are not, then you can not apply to sponsor him/her or it.
  2. To sponsor you must be of 18 years of age or older.
  3. You need to be a Canadian citizen or a permanent resident.
  4. You should be living in Canada.
  5. If you are not living in Canada, then you must provide proof that you will live in Canada. The spouse sponsorship program asks for sponsors to live in Canada after the partner becomes a permanent resident.
  6. Under this program, you must sign an undertaking. As you must support the basic needs of your spouse, and if applicable their dependent child(ren).
  7. You and your partner must sign a mutual agreement. This agreement includes that you are clear and agree with your mutual duties and roles.
  8. You need to show that the govt is not giving you social help for other than disability.
  9. You must have a clean police record.
  10. If you have sponsorship to live in Canada, then you cannot sponsor for at least 5 years.
  11. If you are living in Quebec, then you must follow their separate spouse sponsorship terms.

 

Who cannot sponsor in this program?

You can not sponsor your partner if you:

  1. Are under 18 years of age.
  2. Do not show proof of financial support for earlier sponsorship.
  3. Did not give financial support to a spouse in earlier sponsorship.
  4. Are not living together and one of you is living/in partnership with the third person.
  5. Immigration, Refugees and Citizenship Canada (IRCC) is yet to approve your status in Canada.
  6. Have sponsorship to live in Canada. In that case, you cannot sponsor for at least 5 years.
  7. Have a criminal record.
  8. Declare bankruptcy which is under process.
  9. Are in default on a loan/performance bond.
  10. Are in a removal process.
  11. Do not have any response from CIC for the sponsorship of your current spouse/partner.

 

What are the requirements for applying for Spousal Sponsorship?
  1. Show marriage certificate of marriage from territory/province in Canada.
  2. Show a legal and valid marriage certificate for marriage outside Canada. Your certificate should be acceptable and valid as per Canadian laws and laws of the country of marriage.
  3. Show proof of marriage in an embassy or consulate. Your marriage should be legal as per the country where the embassy or consulate is.
  4. If you are not living in Canada, then you must provide proof that you will live in Canada. The spouse sponsorship program asks for sponsors to live in Canada after the partner becomes a permanent resident.
  5. Under this program, you must sign an undertaking. As you must support the basic needs of your spouse, and if applicable their dependent child(ren).
  6. You and your partner must sign a mutual agreement. This agreement includes that you are clear and agree with your mutual duties and roles.
  7. You need to show the nature of your mutual relationship. The nature of your relationship should be genuine. And your partner should be immigrating because of you and not other reasons.
  8. You need to give proof of a genuine relationship. You must provide a marriage certificate, letters/emails or phone call details, photos of partners, and joint agreements.
